Terms of Use, Disclaimer & Refund Policy

PART 1: GENERAL TERMS — ALL PRODUCTS

1. OVERVIEW

United Earth Fund™ ("UEF") is a 501(c)(3) not-for-profit organization. These Terms of Use, Disclaimer, and Refund Policy (collectively, "Terms") apply to all digital products sold, rented, streamed, downloaded, or otherwise distributed by UEF, including but not limited to software applications, documentary films, media content, and related materials.

By purchasing, renting, downloading, accessing, or using any UEF digital product, you ("User") acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not purchase or use any UEF product.

2. DIGITAL PRODUCT REFUND POLICY

All sales and rentals of digital products are final. No refunds. Due to the nature of digital goods, UEF does not offer refunds, exchanges, or credits for any purchase or rental. By completing a transaction, User acknowledges and agrees to this no-refund policy.

In the rare event of a verified technical issue that renders a product completely non-functional or inaccessible and cannot be resolved through reasonable troubleshooting, UEF may, at its sole discretion, offer a replacement download or store credit. This does not constitute a right to a refund.

3. "AS-IS" DISCLAIMER / NO WARRANTY

ALL UEF DIGITAL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

4. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UEF, ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE ANY UEF PRODUCT, REGARDLESS OF THE THEORY OF LIABILITY.

UEF'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR ANY UEF PRODUCT SHALL NOT EXCEED THE AMOUNT PAID BY THE USER FOR THE APPLICABLE PRODUCT.

5. INTELLECTUAL PROPERTY

All original content, code, footage, editing, production, design, visual elements, audio content, and associated materials created by UEF are the property of United Earth Fund™ and are protected by applicable copyright, trademark, and intellectual property laws. User is granted a limited, non-exclusive, non-transferable license to use or view UEF products for personal, non-commercial purposes only.

Users may not reproduce, distribute, publicly display, publicly perform, modify, or create derivative works from any UEF product without the prior written consent of UEF.

6. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the State of Michigan.

7. MODIFICATIONS

UEF reserves the right to modify these Terms at any time. Updated Terms will be posted on the UEF website. Continued use of any UEF product following any modifications constitutes acceptance of the revised Terms.

PART 2: TUNE YOUR MIND™ AUDIO VISUAL ENTRAINMENT APPLICATION

The following terms apply specifically to Tune Your Mind™ in addition to the General Terms above.

9. HEALTH & SAFETY WARNING

The Application uses rhythmic flashing light synchronized to brainwave frequencies. DO NOT USE THIS APPLICATION IF YOU HAVE EPILEPSY, PHOTOSENSITIVE SEIZURE DISORDER, OR ARE PRONE TO SEIZURES. Stop use immediately if you experience any discomfort, dizziness, nausea, disorientation, or visual disturbance.

The Application is not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The Application is provided for personal wellness exploration only and should not be used as a substitute for professional medical advice, diagnosis, or treatment. Users should consult a qualified healthcare provider before use, particularly if they have any pre-existing medical conditions.

By using the Application, User acknowledges the inherent risks associated with audio-visual stimulation technology and assumes full responsibility for any consequences arising from use.

10. SOFTWARE DISCLAIMER

UEF does not warrant that the Application will be uninterrupted, error-free, or compatible with all devices, browsers, operating systems, or display configurations. Performance may vary depending on the User's hardware, software, network environment, and browser settings. UEF makes no guarantee regarding the Application's performance in any specific technical environment, including but not limited to embedded webpage contexts, mobile devices, or third-party platforms.

11. ASSUMPTION OF RISK

User expressly assumes all risk associated with the use of the Application, including but not limited to risks related to photosensitive responses, audio-induced discomfort, and any other physiological or psychological effects. User agrees to hold harmless and indemnify UEF, its directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to User's use of the Application.

PART 3: DOCUMENTARY AND MEDIA CONTENT

The following terms apply specifically to all documentary films, media content, audio recordings, and related materials distributed by UEF, in addition to the General Terms above.

12. HISTORICAL AND EDUCATIONAL PURPOSE

UEF documentary and media content is presented for historical, educational, and cultural purposes. The views, statements, and practices depicted are those of the individuals featured and do not necessarily reflect the views or positions of United Earth Fund™. Content that documents historical events, individuals, or cultural practices should be understood in the context of its time.

13. FAIR USE AND THIRD-PARTY MATERIALS

UEF documentary and media content and associated promotional materials may include third-party images, photographs, album artwork, publication covers, and other materials used in accordance with the fair use doctrine under Section 107 of the U.S. Copyright Act. Such materials are used for purposes of historical documentation, education, commentary, and nonprofit public awareness. UEF does not claim ownership of third-party materials. Any third-party trademarks, logos, or copyrighted materials remain the property of their respective owners.

14. PRODUCTION QUALITY

Some UEF documentary and media content may have been originally produced decades ago. Where applicable, content has undergone archival restoration. Audio and visual quality may vary. UEF does not warrant any specific level of audio or video quality, resolution, or technical performance.

By purchasing, renting, streaming, downloading, or otherwise accessing any United Earth Fund™ product, I acknowledge that I have read, understood, and agree to be bound by all terms, disclaimers, and policies set forth in this document.
